Agreement to Terms

By accessing or using OpenApply ("Service", "Platform", "we", "us", or "our"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the Service.

Description of Service

OpenApply is a job application tracking platform that helps users:

• Track and organize job applications
• Store resumes and related documents
• Parse job postings from URLs
• Access AI-powered resume reviews (paid feature)
• Generate cover letters using AI (paid feature)
• Import and export application data

Account Registration

To use certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access
• Be at least 16 years of age

User Content and Responsibilities

You retain ownership of all content you upload to OpenApply, including resumes, cover letters, and application notes. By uploading content, you grant us a license to use, store, and process this content solely to provide the Service.

You agree NOT to:

• Upload malicious code, viruses, or harmful content
• Use the Service for any illegal purpose
• Attempt to gain unauthorized access to our systems
• Scrape, copy, or harvest data from the Service
• Share your account credentials with others
• Use the Service to spam or harass others
• Reverse engineer or attempt to extract our source code
• Violate any applicable laws or regulations

Pricing and Payment

Free Features

The following features are free to use indefinitely:

• Unlimited job application tracking
• Notes, tags, and status management
• Document storage (subject to reasonable limits)
• Spreadsheet import/export

Pay-as-you-go Coins

AI-powered features require coins, which you purchase in advance:

• Coins are non-refundable once purchased
• Coins do not expire
• Prices are displayed at checkout
• Payments are processed securely through Stripe
• We reserve the right to adjust coin pricing with notice

AI-Powered Features

Our AI features (resume reviews, cover letter generation) use third-party AI services. You acknowledge:

• AI-generated content may contain errors or inaccuracies
• You are responsible for reviewing and editing AI outputs
• We do not guarantee specific outcomes from AI features
• AI processing involves sharing your data with our AI providers
• You should not rely solely on AI recommendations

Service Availability

We strive to provide reliable service but do not guarantee uninterrupted access. The Service may be unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any disruption, data loss, or damages resulting from service downtime.

Data and Privacy

Your use of the Service is also governed by our Privacy Policy. We recommend reviewing it to understand how we collect, use, and protect your data.

Intellectual Property

The Service, including its design, code, features, and branding, is owned by OpenApply or our licensors and is protected by copyright, trademark, and other laws. OpenApply is open-source software:

• The source code is available on GitHub under the specified license
• You may self-host OpenApply according to the license terms
• Our hosted service branding and infrastructure remain our property
• You may not use our trademarks without permission

Third-Party Services

The Service integrates with third-party services, including:

• Firebase (Google) - hosting and authentication
• Stripe - payment processing
• OpenAI - AI processing
• Job board websites - for parsing job postings

Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party service performance or policies.

Termination

We may terminate or suspend your account immediately, without prior notice, for:

• Violation of these Terms of Service
• Fraudulent or illegal activity
• Abuse of the Service or other users
• Non-payment or payment disputes
• Inactivity (after reasonable notice)

You may terminate your account at any time through account settings. Upon termination, your right to use the Service ceases immediately. Unused coins are non-refundable.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OPENAPPLY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS, OR $100, WHICHEVER IS GREATER.

Indemnification

You agree to indemnify and hold harmless OpenApply and its affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any rights of another party.

Governing Law and Disputes

These Terms are governed by the laws of the jurisdiction where OpenApply operates, without regard to conflict of law provisions. Any disputes shall be resolved through binding arbitration or in the courts of our jurisdiction, as applicable.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Your continued use of the Service after changes constitutes acceptance of the new Terms. If you disagree with the changes, you must stop using the Service.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and OpenApply regarding the Service and supersede all prior agreements.
